What is Litigation?

Litigation is a judicial contest to resolve a conflict between two or more parties and to determine and enforce legal rights.

Although Elder & Disability Law Advocates has experience and competence in Massachusetts and Federal Civil, Criminal and Probate Courts, our concentration is in Probate litigation.

The following types of litigation are included in the scope of litigation services offered:

Guardianship and Conservatorship Services

Elder and Disability Law Advocates represents clients seeking guardianship and conservatorship of relatives who can no longer manage their personal or financial affairs and assists family members in fulfilling the duties imposed by these new roles, whether uncontested or contested.

Probate Litigation

Elder and Disability Law Advocates represents both fiduciaries, such as executors, trustees, conservators, guardians and attorneys-in-fact, as well as beneficiaries, with respect to the following types of probate litigation: Accounting Actions, Claims Against Fiduciaries, Fiduciary Claims Against Third Parties, Trust Actions, and Will Contests.
